Gadsby Wicks Wins Case for Client Injured During Gallbladder Surgery

The case

Mrs B (anonymised to protect her and her family’s privacy) was admitted to a private hospital for the surgical removal of her gallbladder, although the procedure was performed under an NHS contract.

During the operation, the surgeon responsible for Mrs B’s cholecystectomy accidentally cut across the common bile duct, mistaking it for the cystic duct. Her surgery was immediately stopped after this error was discovered in the operating theatre.

To carry out the necessary repairs and complete Mrs B’s procedure, she was quickly transferred by ambulance to another hospital and underwent follow-up surgery the next day.

The claim

Gadsby Wicks pursued this claim on the basis that the surgeon’s mistakes amounted to inadequate surgical technique.

If Mrs B’s operation had been performed competently, she would not have required follow-up open surgery, leading to a faster recovery time. The damage done to her bile duct has also left her at an increased risk of biliary stricture and small bowel obstruction, meaning she now must have regular liver function tests for the rest of her life.

The result

The Defendants quickly admitted both breach of duty and causation, allowing the claim to settle before proceedings were issued.
